Counseling in litigation is when a lawyer provides legal advice and guidance to a client involved in a lawsuit or potential lawsuit. The purpose of counselling in litigation is to assist the client in understanding the legal issues involved
in the case, the strengths and weaknesses
of their position, and the potential outcomes
and risks of the case. During the counselling
process, a lawyer may review relevant laws, regulations, and case law, as well as gather and analyse evidence, interview witnesses, and
develop a strategy for resolving the dispute.
The lawyer may also discuss potential settlement
options with the client, as well as the costs and benefits of going to trial.
